TERMS OF SERVICE
Payment is paid upfront through Paypal or Ko-fi. The only exception is a Vtuber Model which will allow 50% upfront and 50% before delivery.
Product will be delivered digitally.
Seller will not be responsible for loss of product once it has been delivered.
Customer has right to three complete revisions in the sketching phase.
Customer has right to reasonable amounts of minor edits after completion (I.E eyecolour change)
Must be paid in USD.
Customer can ask for a refund on orders with no progress, or if I, the artist, decide I'm no longer able to finish your commission which will result in full refund.
Customer is required to contact the seller in a fast and responsive manner, no longer than 4 days.
Products cannot be used for commercial use without additional fees.
I, the artist, can cancel and refund any order at any time.
Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.
CONDENSED TERMS OF SERVICE
NOTICE: This is the CONDENSED version of the T.O.S.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders.
TERMS OF SERVICE
FULL TERMS OF SERVICE:
LAST UPDATE: July 19th, 2025This contract applies to the artist further called Seller while person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller, the Customer agrees to the following terms and conditions:
PAYMENT:
Customer agrees to pay the due amount upfront for all orders except for orders pertaining to Vtuber Models which allows 50% of total upfront and 50% before final delivery of product.
Customer accepts that work on the Product will not commence until payment has been received by Seller according to the above schedule.
CHARGEBACKS:
If the Customer issues a charge back on one of the products, without discussing it with the Seller beforehand- the Seller has the full right to resell whatever was sent to the Customer and make profit off of it.
As soon as a chargeback happens, the Customer no longer owns the rights to use the product the Seller has made and will be blacklisted from any future purchases.
PRODUCT DELIVERY:
Customer agrees that Product will be delivered digitally on Google Drive to an email address provided by Customer, or through Discord account if specified and agreed upon, after the final payment has been received by the Seller.
It is sole responsibility of Customer to propose delivery location which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.
Rushing will not be allowed unless an extra fee has been paid. The Customer is to expect a delivery time of 3 weeks to 3 months depending on the Seller's availability. The Seller may not be rushed in any way although being asking for updates is accepted. Rush fee is +30% of service price. Rush fee added means the Seller will work on the product in their free time to get it done ASAP.
REVISIONS:
Customer has the right to 3 complete revisions in the sketching phase for both illustrations and designs. None after.
Customer has right to a reasonable amount of minor edits after completion, such as changing an eyecolour or fixing a small detail. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately before final work is delivered. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.
Pertaining to a Vtuber Model art purchase, the Customer has the right to 3 complete revisions in the sketching phase as the Seller will be referencing using a detailed reference sheet, provided by the Customer.
Customer has right to a reasonable amount of minor edits during stages after sketches completion, such as changing an eye color or fixing a small detail but must follow the reference with little to no additions.
CURRENCY CONVERSIONS:
Customer agrees to pay the total amount specified in USD.
It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
Payment is considered as received and completed only when total amount received on Seller's Paypal account is equal to the invoice amount in USD.
REFUNDS:
None. The seller's services are non-refundable. By commissioning a product, the Customer agrees that once work is started, they can no longer chargeback. If the Seller decides they are no longer available to finish the product, a full refund will be initiated.
Customer obliges to contact the Seller in a fast and responsive manner within 4 days, responding swiftly to any requests for comments, clarifications, opinions, validation of progress, etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.
CANCELLATIONS:
Seller reserves every right to refuse or cancel any order, under condition of full refund, without giving reasons to Customer.
Any disrespectful behavior will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.
PERSONAL USE AND COMMERCIAL USE:
The Product received by Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product. If planned to make an item such as merch with anything that the Seller has worked on, a bigger commercial fee will be discussed.
Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space. It is strictly prohibited.
In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space. It is strictly prohibited.
COPYWRITE:
The Seller owns the copyrights to everything the seller has drawn or made. The Customer can buy the rights from the seller with agreed conversation. Do not edit any files, unless the person with full copywrites has made the edits.
RESELLING:
If the Customer plans to resell art they have commissioned from the Seller, they are not allowed to sell it for bigger price than they paid for the original product.
CREDITING:
Seller agrees to credit the Seller (@Venydetta) as the Artist / Live2D rigger when posting on any locations or sites. The Customer can upload the commission the artist made for them but it is agreed it would be linked to @Venydetta's carrd page, twitch, twitter, etc.
For VTuber Model art, the Customer is also required to list the Seller as the model creator on social medias within reason or when asked.
WATERMARKS:
All updates will include a watermark to prevent stealing or theft. Once the Customer has approved the final piece, the Seller will send versions with watermark for public use and without watermark for private use.

VTuber Model Art
My models come with a detailed separation. I don't separate extra layers after the model has been delivered. I do, however, fix mistakes that I may have made and haven't noticed before delivering.

Make sure you have a detailed reference of your character before commissioning a model from me. I won't sketch/add new things that aren't included in the design you provide, unless you agree to pay extra design assistance fee.
I may not accept your commission if your model has:
1) Very complex animation request
2) Too many toggles (2+ hairstyles / 2+ outfits / lots of accessories / etc.)
